Terms of Use

These conditions govern each visit to Hidalgo County Criminal History. Reading content, opening a page, or using a search tool means that you accept them. Do not continue to use the website if you disagree.

NO FCRA USE. Hidalgo County Criminal History is privately operated and has no government affiliation. It and its advertising partners do not offer a service for credit, employment, insurance, tenant, or other FCRA-regulated decisions. The resource points readers toward public criminal-record sources in Hidalgo County, New Mexico. It is neither a private investigation firm nor a consumer reporting agency.

1. What This Website Is

This private reference site operates independently of all government offices. It cannot file documents, conduct an official check, retrieve a record for a user, or store an official criminal file.

Its role is to identify the Hidalgo County sheriff, detention facility, New Mexico courts, DPS State Central Repository, NMCD, and New Mexico DPS Sex Offender Registry as custodians, while also linking to outside research tools.

2. Rules for Using This Site

Use is conditioned on an agreement not to:

  • Use automated scrapers, bots, or similar tools against the pages
  • Harass, stalk, threaten, or intimidate a person with information found here
  • Make a housing, hiring, lending, or insurance decision from site content
  • Gain unauthorized access or interfere with another visitor's use
  • Violate a local, New Mexico, or federal law

3. No Harassment, Stalking, or Discrimination

No site or linked-tool information may be used to stalk, harass, threaten, intimidate, or discriminate. Misuse may be criminal. The limit is especially important for the New Mexico DPS Sex Offender Registry, whose terms reserve public data for safety awareness and bar vigilante action. The New Mexico Inspection of Public Records Act does not authorize misuse of a public record.

4. We Are Not a Consumer Reporting Agency

Hidalgo County Criminal History is not a consumer reporting agency under the FCRA and does not create credit reports, background checks, or consumer reports. Its partners do not provide tools intended to evaluate applicants, renters, insurance risk, or credit. Site and linked-tool data must not be used to:

  • Decide whether to hire or fire someone
  • Screen potential renters or housing applicants
  • Judge creditworthiness or set insurance premiums
  • Determine who qualifies for licenses, permits, or government programs
  • Do anything else that falls under FCRA rules

A legally permitted check for an FCRA purpose must come from an FCRA-compliant provider or the proper official process. Section 29-10-6 NMSA limits inspection of New Mexico arrest-record information, and DPS requires subject authorization for its personal record route.

5. No Legal Advice

General explanations about Hidalgo County records are not legal advice. A licensed New Mexico attorney should address how a warrant, charge, conviction, or expungement law applies to a specific set of facts.

6. No Warranties

All content is supplied "as is," without a guarantee that:

  • The information here is accurate, complete, or current at any given time
  • The site will stay up and running without interruptions
  • Our pages are free of errors, bugs, or security holes
  • Results from our partner search tools will be thorough or accurate

Charges, outcomes, expungements, and access rules can change a record. Gaps and delays are possible, and no site statement replaces confirmation from a Hidalgo County court, sheriff, DPS, or another official custodian.

7. Third-Party Services and Links

An outside link may lead to a sheriff, court, New Mexico agency, legal resource, or search provider. The destination controls its availability, data practices, fees, and content. Review its terms because this site is not responsible for them.

8. Intellectual Property

Hidalgo County Criminal History or its content partners own the site's text, graphics, logos, and code. Written permission is required to copy, distribute, modify, or make derivative use of that material.

9. Limits on Our Liability

To the broadest extent allowed by law, the site is not liable for harm tied to its use, including reliance on information from a page or linked service.

10. Indemnification

A user agrees to hold the site harmless from claims, demands, or proceedings caused by that user's conduct or breach of these terms, including related legal fees and costs.

11. Governing Law

New Mexico law governs these terms. Any dispute arising from use of the website must be brought in a court located in New Mexico.

12. Changes to These Terms

Revised terms take effect when the new version is posted on this page.

13. Cutting Off Access

Access may be restricted or ended at any time, for any reason, without advance notice.

14. Severability

If one provision is held invalid or unenforceable, all remaining terms continue. The affected language will be adjusted only as far as needed to make it enforceable.

15. Questions

Questions about these conditions may be sent through the Contact page.
